Terms of Service

1. Acceptance of Terms

By accessing or using GoldChain's blockchain-based gold traceability platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Eligibility

You must:

  • Be at least 18 years of age
  • Have legal capacity to enter into binding contracts
  • Hold necessary licenses for gold mining or trading activities
  • Comply with Ghana Gold Board Act 1140 and all applicable laws

3. Account Registration

3.1 Account Creation

You must provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for:

  • Maintaining confidentiality of your account credentials
  • All activities conducted under your account
  • Immediately notifying us of unauthorized access

3.3 Verification

We reserve the right to verify your identity, mining licenses, and compliance documents before granting full platform access.

4. Platform Use

4.1 Permitted Use

You may use the Platform to:

  • Record legitimate gold mining and trading transactions
  • Verify gold supply chain authenticity
  • Generate compliance reports
  • Access your transaction history

4.2 Prohibited Use

You may NOT:

  • Submit false, fraudulent, or misleading information
  • Attempt to circumvent platform security measures
  • Facilitate illegal mining, smuggling, or money laundering
  • Reverse engineer or copy platform technology
  • Use the Platform for any unlawful purpose
  • Interfere with other users' access

5. Blockchain Transactions

5.1 Immutability

Important: All transactions recorded on the blockchain are permanent and immutable. Once confirmed, transactions cannot be reversed, deleted, or modified.

5.2 Transaction Accuracy

You are solely responsible for ensuring accuracy of transaction data before submission. Review all information carefully before confirmation.

5.3 Gas Fees

Blockchain transactions may incur network fees ("gas fees"). You are responsible for all applicable fees.

6. Compliance and Legal Requirements

You agree to:

  • Comply with Ghana Gold Board Act 1140
  • Maintain valid mining or trading licenses
  • Provide accurate location and certification data
  • Cooperate with regulatory authorities
  • Report suspicious or illegal activities

7. Data and Privacy

Your use of the Platform is subject to our Privacy Policy. By using the Platform, you consent to data collection and processing as described in our Privacy Policy.

8. Intellectual Property

8.1 GoldChain IP

All Platform content, features, and functionality are owned by GoldChain and protected by international copyright, trademark, and intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purposes.

9. Fees and Payment

Platform fees are based on transaction volume and features used. Fees are subject to change with 30 days' notice. Unpaid fees may result in account suspension.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDCHAIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

11. Indemnification

You agree to indemnify and hold harmless GoldChain from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Platform.

12. Termination

12.1 By You

You may terminate your account at any time by contacting support.

12.2 By GoldChain

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activities
  • Fail to maintain required licenses
  • Pose security or legal risks

13. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with Ghana's Arbitration Act. Arbitration shall be conducted in Accra, Ghana.

14. Governing Law

These Terms are governed by the laws of the Republic of Ghana, without regard to conflict of law principles.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance.
